Homeowners can file directly with the Secretary of State. A hearing officer investigates without litigation, and disputed fines or fees are automatically stayed.
The foreclosure threshold rises from $2,000 to $4,000. Written notice is required, and pending complaints can pause foreclosure.
Payments must apply in order: regular, special, specific assessments, then fees and fines. Partial payments cannot be refused or accelerated.
Before collection or award, HOAs must send certified notice and give 30 days to pay. Judges must review attorney's fees for reasonableness.
Georgia now enumerates rights to attend meetings, inspect records, receive proper notice, and expect board members to act in good faith.
